Event Disclaimer & Photo/Video Release
WAIVER - PEDAL KIDS / BUDDY PEGS MINOR/PARTICIPANT WAIVER
You are required to read the following information very carefully, make sure that you understand it fully, and sign it before allowing your child(ren), the participant(s) being represented and/or yourself to participate in any activity affiliated with Buddy Pegs, LLC, dba Pedal Kids USA (including all Buddy Pegs Learn To Ride & Bicycle Playdate/Playground programs).

As the parent/caregiver/signee, I acknowledge and understand that participating in any activity affiliated with Buddy Pegs, LLC (including Buddy Pegs Learn To Ride & Bicycle Playdate/Playground programs) and demoing bicycles may carry the risk of personal injury or harm to my child(ren), the participant(s) being represented, and/or myself.

I knowingly and freely assume all such risks, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others. I also accept full responsibility for my child(ren), the participant(s) being represented, and/or my own participation.

I hereby agree to release and hold harmless Buddy Pegs LLC (Releasee) and its officers, employees, volunteers, location hosts, committees and boards, from and against any and all liability, loss, damages, claims, or actions (including costs and attorneys fees) for bodily injury and/or property damage, to the extent permissible by law.

This indemnification and hold harmless agreement shall include indemnity against all costs (including without limitation, reasonable attorney's fees and court costs), expenses and liabilities incurred in or in connection with any such claim or proceeding brought thereon and in defense thereof.

In additional consideration of Buddy Pegs LLC making bicycle(s) available to my child(ren), myself and/or the participant(s) being represented:
  1. I hereby agree to assume all risks and accept full responsibility for any damage, loss, or theft that may occur due to the use, operation, and/or possession of the bicycle(s) by my child(ren), the participant(s) being represented, and/or myself.
  2. I hereby waive and forever relinquish any and all rights and claims which I, or my heirs, executors, administrators, successors or assigns may now or in the future have against Buddy Pegs LLC, Woom Bikes USA, Prevelo Bicycles and any of their respective affiliates, partners, related entities, agents, directors, officers, and employees (collectively the “indemnities”) in connection with any injury, including death, or property damage, which my child(ren), the participant(s) being represented and/or myself may suffer in using, operating, and/or possessing the bicycle.
  3. I hereby agree to indemnify the Indemnitees and hold them harmless from and against any and all liabilities, losses, damages, claims, causes of action, costs, and expenses (including reasonable attorney's fees), arising out of or in connection with, directly or indirectly, the operation and/or possession of the bicycle(s) by my child(ren), the participant(s) being represented, and/or myself.
  4. I acknowledge that Buddy Pegs LLC has recommended the use of protective helmets and has offered to provide helmets for my child(ren), the participant(s) being represented, and/or myself. I am also aware that local laws require individuals under the age of 18 to wear a helmet while riding a bicycle.
 
I have read and understand this release, indemnification and hold harmless form. I further certify that my child(ren), the participant(s) being represented and/or myself are in good physical condition, and have no medical or physical conditions that would restrict their/my participation in this activity or program.
 
PHOTO/VIDEO RELEASE

In consideration of my child(ren), the participant(s) being represented, and/or myself participating in associated Buddy Pegs activities (including all Buddy Pegs Learn To Ride & Bicycle Playdate/Playground programs), I grant permission for Buddy Pegs to utilize the appearance of my child(ren), the participant(s) being represented, and/or myself in connection with any Buddy Pegs Photo/Video Production. I grant Buddy Pegs all rights, in perpetuity, to use the performance, appearance, name, and/or voice of my child(ren), the participant(s) being represented, and/or myself in connection with the Buddy Pegs Video Production.

I authorize Buddy Pegs to audio/video/photo record the performance, edit it at its discretion, include it with the performances of others, and incorporate it into the Buddy Pegs Video/Photo Production or other programs. This may include the use of sound effects, special effects, and music. I understand that these recordings and photographs may be used in any manner or media, including but not limited to publicity, advertising, and sales promotion. I acknowledge that Buddy Pegs owns all rights to the results and proceeds of the services rendered by my child(ren), the participant(s) being represented, and/or myself in connection with this agreement.

I agree that Buddy Pegs has sole discretion in editing my child(ren)'s, the participant(s) being represented's, and/or my child's participation in the Buddy Pegs Video/Photo Production. I consent to the use of my child(ren)'s, the participant(s) being represented's, and/or my child's likeness and voice in connection with Buddy Pegs Video/Photo Production publicity and related institutional promotional purposes. I release Buddy Pegs, its agents, employees, licensees, and assigns from any and all claims, including but not limited to invasion of privacy, defamation, or any other cause of action arising from the production, distribution, broadcast, or exhibition of the Buddy Pegs Video/Photo Production.


Minors names will NOT be used in any photo/production with out further authorization from Legal Guardian.
 
By signing this form, I am opting in to email communications from Buddy Pegs, LLC. I also provide my consent to receive text and phone communications from Buddy Pegs, LLC.
